1. Scope of Services & Educational Disclaimer (No Patient-Provider Relationship)

• Educational Purpose Only: All workshops, keynotes, parent education groups, speaking engagements, and digital content provided by EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar are for educational, informational, and skill-building purposes only.

• Not Clinical Therapy or Healthcare: Although our founder is a Licensed Clinical Social Worker (LCSW), participation in our workshops, groups, or online spaces does not establish a clinical therapist-patient relationship, medical care, or clinical social work treatment.

• No Emergency Services: Our Services are not a substitute for professional mental health therapy, diagnosis, or crisis intervention. If you are experiencing a mental health emergency, please call 988 (Mental Health Crisis Lifeline), call 911, or go to the nearest emergency room.

2. Booking, Registration, and Funding

• Service Agreements: Custom workshops, school campus presentations, faith organization retreats, and corporate/non-profit engagements are governed by individual Master Service Agreements (MSAs) or Statements of Work (SOWs). In the event of a conflict between these Terms and a signed MSA/SOW, the signed agreement shall control.

• Funding Eligibility: Clients utilizing Title I, Title III, community grants, ministry budgets, or private/self-funded arrangements are responsible for ensuring that payment authorization complies with their respective institutional or grant requirements.

3. Intellectual Property Rights & Trademark Attribution

• Company Ownership: All original content, workshop slides, custom workbooks, framework materials (including materials related to the EMBRACE pillars), logos, graphics, and text on this website and within our programs are the exclusive property of EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar or its licensors.

• Third-Party Trademarks & Facilitation: Método de Paternidad Efectiva® is a registered trademark owned by its respective creators and rights holders. EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar acts strictly as an independent Certified Facilitator of the Método de Paternidad Efectiva® framework. We do not claim ownership of the Método de Paternidad Efectiva® trademark, core brand, or master curriculum.

• Limited License: Participants and clients are granted a non-exclusive, non-transferable, revocable license for personal, non-commercial use of provided workshop materials. You may not record, retransmit, duplicate, distribute, resell, or create derivative works from our materials without express written consent from EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar and/or the respective trademark owners.

4. Language & Session Delivery

• Services are offered in English or Spanish as agreed upon prior to event delivery.

• Requests for language changes or bilingual adjustments must be finalized in writing prior to event execution as outlined in your specific contract.

5. Limitation of Liability

To the maximum extent permitted by applicable law (including the laws of the States of Texas and Illinois):

• EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar, its owner, employees, and independent contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of your access to, reliance on, or use of our website, materials, or Services.

• In no event shall our total aggregate liability exceed the total amount paid by you or your organization to EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar in the twelve (12) months preceding the claim.

6. User Conduct & Group Rules

For groups, workshops, and community events:

• Respect & Confidentiality: Participants agree to foster a safe, respectful environment. While we encourage mutual respect, EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar cannot guarantee complete confidentiality of information shared by participants in open group settings.

• Termination of Access: We reserve the right to remove any participant from a session or platform who exhibits disruptive, abusive, or harmful behavior, without refund.

7. Third-Party Links & Resources

Our website or materials may contain links to third-party websites or community resources. EMBRACE Wellbeing, PLLC DBA EMBRACE Bienestar does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party entities.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas (and, where applicable to clinical licensure jurisdiction, the State of Illinois), without regard to its conflict of law principles.
